Two free-market legal groups are suing New York Attorney General Eric Schneiderman for what they say are public records related to the ongoing investigation into whether Exxon Mobil Corp. misled investors and the public about how climate change may affect its business.

The Free Market Environmental Law Clinic and the Energy & Environment Legal Institute asked in their petition, which they released Aug. 1, for the New York Supreme Court to rule certain documents were public records and order them released.

In their original request in May under New York’s Freedom of Information Law, the groups sought copies of all correspondence between Schneiderman and eight other individuals related to the climate change investigation. On June 10, the office denied the request in full, claiming the records sought were privileged.
