Washington, D.C. – Yesterday, the Energy & Environment Legal Institute (E&E Legal), joined the Pacific Legal Foundation, Cato Institute, National Federation of Independent Business Legal Center, Reason Foundation, and the California Manufacturers and Technology Association in an amicus brief urging the U.S. Supreme Court to review a Ninth Circuit decision that upholds California’s Low Carbon Fuel Standard against a commerce clause challenge brought by several fuel producers and consumer groups.  The plaintiffs, Rocky Mountain Farmers Union, et al, have appealed the case to the U.S. Supreme Court asking them to reverse the lower court’s decision, and the brief supports their petition.
