An energy advocacy organization and a large trucking association filed a lawsuit challenging the validity of an Environmental Protection Agency panel that is writing regulations to control particulate matter pollution.

The lawsuit, filed Friday in U.S. District Court in Washington D.C., claims that most of the members of the independent scientific review committee are not independent. The suit said that 22 of the 26 members received a combined $192 million in EPA grant money and are dependent on the agency for research funds.

It was filed by the Energy and Environment Legal Institute, a Washington, D.C.-based group that has previously filed lawsuits challenging EPA regulation of particulate matter pollution and other issues. The institute describes itself as an “organization engaged in strategic litigation, policy research, and public education on important energy and environmental issues.”
