Steve Milloy, E&E Legal Senior Policy fellow and Junkscience.com Founder, filed comments regarding the EPA’s Reconsideration of 2009 Endangerment Finding and Greenhouse Gas Vehicle Standards
The comments, filed on September 19, 2025 on behalf of the Energy & Environment Legal Institute (E&E Legal), began, “The endangerment finding should be rescinded because it is plainly illegal under the 2022 SCOTUS decision in West Virginia v. EPA. Under the major questions doctrine, EPA may only undertake a major regulatory program if it has express authorization from Congress.”
Milloy then relied heavily on his extensive scientific background to undercut the entire foundation of the Left’s arguments that brought us this unprecedentedly bad economy killing public policy in the first place. For example, he says, “While carbon dioxide is an important greenhouse gas, there is no actual science that shows manmade emissions of CO2 or any other greenhouse gas have had any effect whatsoever on the weather or climate. That is, despite decades of weather and/or climate modelling experience, no weather or climate prediction based on greenhouse gas emissions has ever been verified as having anything to do with greenhouse gas CO2 emissions.”
