On May 13, 2025, Steve Milloy, E&E Legal Senior Policy Fellow and Junkscience.com Founder, was one of the expert panelists at the Heritage Foundation’s Climate Event: “Is the Sky Falling? Reconsidering the Endangerment Finding.”  The full-day event featured four panels and a keynote address over lunch by Lady Sarah Elliott of Mickle Fell, Director of the Special Relationship Unit at the Prosperity Institute in London.

Milloy, who has been involved in the Climate issue for more than 30 years and has written the seminal book on reforming the EPA, was part of Panel II: Climate Change and Public Health and his presentation was titled, Political Science: EPA, PM2.5 and the Endangerment Finding.

Milloy noted that the 2022 Supreme Court Case, West Virginia v. EPA, gives the Trump Administration the authority to declare the Endangerment Finding invalid since the decision overturned their previous 2007 Massachusetts v. EPA decision, which established the Endangerment Finding initially.

He added that the EPA doesn’t conduct “scientific science” as most assume to set their onerous regulations.  Rather, the agency conducts “scientific policy,” which boils down to political science.  In other words, they can and do ignore scientific evidence that runs counter to the wishes of the Environmental Left and set whatever economy-killing regulations they wish.
